Copyright & Usage: A USB with high resolution digital images will be sent to the bride and groom immediately upon completion. The Client or their friends/family are not authorized to make reproduction of the images for commercial use or for photographic competition or display. The Client and their friends/family are not authorized to edit, alter, or change the images in any way. For best printing results, the Client should order their prints through a reputable lab. Printed images should resemble the images on the disc and it is the fault of the printer if they do not match.
Sarahlynn Photography&Design retains copyright on all the images created and will have the right to make reproductions for portfolio samples, self promotion, publication, display, professional competition or other purposes unless discussed in advance that the client would prefer not to make their photos public. All photographs are the property of Sarahlynn Photography&Design and will remain her property and are protected by Copyright Laws of Canada. Due to the changing and fluid nature of this type of event, Sarahlynn Photography&Design, does not guarantee the production of any specific image.
Payment: Half of the payment should be received after the first meeting with the Clients or when contract is signed, which will be non-refundable. The other half of payment should be received one month to two weeks prior to the wedding unless otherwise discussed. Photos will not be given to the Clients unless full payment has been given to Sarah Switzer.
Travel fees & Accommodations: Any location outside of Calgary, Alberta would be charged with travel expenses. The travel cost is $0.40 per kilometre. If Sarahlynn Photography&Design is required to stay overnight (wedding that go past 8pm) or Sarahlynn Photography&Design is required to be at the Rehearsal a day before, accommodations are to be covered by the Bride & Groom.
Responsibilities: Unless agreed upon in advance, Sarahlynn Photography&Design shall be the exclusive photographer retained for the event. Other vendors as well as semi-professional photographers must not obstruct or interfere with the official photography. Wedding guests may take photos outside of formal sessions, but it is the responsibility of the Client to prevent family and friends from interfering with the Photographer's duties. Sarahlynn Photography&Design is not responsible for compromised coverage due to causes beyond her control such as other people's camera or flash, the lateness of the bride or groom, family members and wedding party or other principles, weather conditions, schedule complications, rendering of decorations or restrictions of the officiate or vendor. Sarahlynn Photography&Design is not responsible for existing backgrounds or lighting conditions which may negatively impact or restrict Sarahlynn Photography&Design and in event of bad weather a backup indoor location with lots of natural lighting would be the top preference.
Photos: Sarahlynn Photography&Design may require the assistance of the volunteer in organizing family groups. The CLIENTS also agree to give Sarahlynn Photography&Design sufficient warning of keys events at the wedding that need to be captured, in order to give Sarahlynn Photography&Design time to prepare (e.g. Bouquet toss, cutting the cake, speeches, any choreographed dances, etc.) Please note that not all the guests at weddings like having their
photo taken. In such cases, Sarahlynn Photography&Design will use her discretion, but cannot be held responsible for a lack of photos of these people.
Requested Photos: While Sarahlynn Photography&Design will make every reasonable effort to take photos specifically requested by the Client; the Client understands that this is an uncontrolled event and that due to varying in the weather, available light, time restrictions, and willingness of subjects, Sarahlynn Photography&Design cannot guarantee that ALL requested photos can be taken.
Creative Licence: Images are edited at the Photographer's discretion and Sarahlynn Photography&Design reserves the right to edit and release only those deemed credible as professional in quality and within the Photographer's artistic standards. RAW images will not be given out to the Clients.
Limit of Liability: If Sarahlynn Photography&Design is too ill or becomes injured and cannot supply the wedding services specified above, Sarahlynn Photography&Design will try to book a replacement wedding photographer. Under normal circumstances, a second photographer from Sarahlynn Photography&Design is there for the day anyway and Sarahlynn Photography&Design will then shoot the day on his/her own. If both photographers are unavailable and a replacement photographer cannot be found, then liability is limited to a refund of everything but the retainer fee. Sarahlynn Photography&Design has working methods in place in place to prevent loss or damage to images. However, if there is the unlikely possibility that images may be lost, stolen, or destroyed for reasons beyond our control. These circumstances, liability is limited to the return of fees except the retainer fee for the service or part thereof according to the percentage of images supplied.
Meal Service: A light meal is required for Sarahlynn Photography&Design for events up to five (5) hours. For events of more than five (5) hours, a full course meal is required. If no meal is provided, Sarahlynn Photography&Design will leave the event to secure a meal. Event time is based on the start to the end of the photography services.
USB Storage: Sarahlynn Photography&Design recommends that you back up your images on another media format other than the USB given. It is also recommended to place photos on more than one back up location to ensure the images for years to come. Sarahlynn Photography&Design cannot be held responsible for the failure of the USB due to mishandling. Should the Client want an additional copy of the photos on another USB, there will be a $55 fee.
This contract shall be governed by the laws of the Country of Canada in the Province of Alberta and any applicable Federal law.
We understood the contents of this contract and agree to the terms therein.
